1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of the pharaoncastlegaming.com website and all associated services, features, content, and interactive entertainment modules (collectively, the "Platform"). By accessing or using the Platform, you agree to be bound by these Terms in their entirety. If you do not agree to these Terms, you must immediately discontinue use of the Platform. 3. Account Terms

4. Acceptable Use

You agree to use the Platform only for lawful purposes and in accordance with these Terms. You shall not:

• Use the Platform in any way that violates any applicable federal, provincial, or local law or regulation in Canada.
• Attempt to gain unauthorized access to any portion of the Platform, other user accounts, computer systems, or networks connected to the Platform.
• Use any automated means, including bots, scrapers, or crawlers, to access, collect, or interact with the Platform without our express written permission.
• Introduce any viruses, trojans, worms, logic bombs, or other material that is malicious or technologically harmful.
• Impersonate or attempt to impersonate Pharaon Castle, a Pharaon Castle employee, another user, or any other person or entity.
• Interfere with or disrupt the integrity or performance of the Platform or the data contained therein.
• Use the Platform to harass, abuse, threaten, or intimidate any other user or third party.
• Engage in any activity that could damage, disable, overburden, or impair the Platform's servers or networks.

We reserve the right to investigate and take appropriate legal action against anyone who violates these provisions, including removing content, suspending access, and reporting violations to law enforcement authorities.

5. Intellectual Property

All content, features, and functionality on the Platform, including but not limited to text, graphics, logos, icons, images, audio clips, animations, interactive modules, software, and the overall design and arrangement thereof, are owned by Pharaon Castle or its licensors and are protected by Canadian and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws. The Pharaon Castle name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Pharaon Castle. You may not use such marks without our prior written permission. You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for personal, non-commercial entertainment purposes, subject to these Terms. This license does not include the right to reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any material from our Platform, except as incidentally necessary for normal web browsing.

6. Social Gaming Disclaimer

Pharaon Castle is a free social arcade entertainment platform. All interactive modules and digital experiences on the Platform, including Book of the Pharaohs, are provided purely for entertainment purposes. No real-world monetary value is attributed to any virtual items, points, scores, achievements, or other in-platform elements. You acknowledge and agree that: (a) the Platform does not involve any form of financial transaction, purchase, or exchange of value; (b) virtual items, credits, or points earned or accumulated on the Platform have no cash value and cannot be exchanged, transferred, or redeemed for anything of monetary value; (c) outcomes within our interactive modules are determined by random number generators and are designed for entertainment only; and (d) Pharaon Castle does not promote, facilitate, or endorse any form of financial activity. The Platform is intended as a social entertainment experience where users can enjoy colorful games and interact with a community of like-minded Canadian adults in a safe, free-to-play environment.

7. Limitation of Liability

To the fullest extent permitted by applicable Canadian law, Pharaon Castle, its directors, officers, employees, agents, partners, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, data, use, goodwill, or other intangible losses, resulting from: (a) your access to or use of, or inability to access or use, the Platform; (b) any conduct or content of any third party on the Platform; (c) any content obtained from the Platform; or (d) unauthorized access, use, or alteration of your transmissions or content. The Platform is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Platform will be uninterrupted, secure, or error-free, or that any defects will be corrected. In no event shall our total liability to you for all claims arising out of or relating to the use of the Platform exceed one hundred Canadian dollars (CAD $100).

8. Indemnification

You agree to defend, indemnify, and hold harmless Pharaon Castle, its parent company, subsidiaries, affiliates, officers, directors, employees, agents, licensors, and service providers from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable legal fees) arising out of or relating to your violation of these Terms, your use of the Platform, your violation of any rights of a third party, or any content you submit or transmit through the Platform. This indemnification obligation will survive the termination of these Terms and your use of the Platform. We reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will cooperate with us in asserting any available defenses.

9. Termination

We may terminate or suspend your access to the Platform immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms. Upon termination, your right to use the Platform will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including without limitation ownership provisions, warranty disclaimers, indemnity obligations, and limitations of liability. You may discontinue your use of the Platform at any time. If you wish to have any personal information we may hold about you deleted, please submit a request to our Privacy Officer in accordance with our Privacy Policy.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law provisions. You agree that any legal action or proceeding arising out of or relating to these Terms or your use of the Platform shall be brought exclusively in the courts of the Province of Ontario, Canada, and you consent to the personal jurisdiction and venue of such courts. Notwithstanding the foregoing, we retain the right to bring proceedings against you for breach of these Terms in your province or territory of residence or any other relevant jurisdiction. The application of the United Nations Convention on Contracts for the International Sale of Goods is expressly excluded.

11. Dispute Resolution

In the event of any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof, including the determination of the scope or applicability of this agreement to resolve disputes, the parties agree to first attempt to resolve the dispute informally. You agree to contact us at legal@pharaoncastlegaming.com with a written description of your claim, and we will attempt to resolve the dispute through good-faith negotiation within 30 days. If the dispute cannot be resolved informally within that period, either party may pursue formal resolution through the courts of Ontario as specified in Section 10. Nothing in this section shall prevent either party from seeking injunctive or other equitable relief from a court of competent jurisdiction where necessary to prevent irreparable harm.
